Аннотация. Долговременная эволюция законодательной базы в области частной экономической деятельности предопределила на современном этапе разнообразные подходы к пониманию соотвтствующего конституционного права. Политика протекционизма, практиковавшаяся многими государствами в условиях построения конституционного строя, повлияла на формирование различных концепций к правовому статусу личности и месту субъективного права на занятие экономической деятельностью в системе прав человека и гражданина. Существуют и альтернат точки зрения, в соответствии с которыми отдельные авторы выделяют конституционно-идеологические, конституционно-прогрессивные, конституционно-демократические и иные способы в обеспечении права на занятие экономической деятельностью.

Abstract. The long-term evolution of the legislative framework in the field of private economic activity has predetermined at the present stage a variety of approaches to understanding the relevant constitutional law. The policy of protectionism, practiced by many states in the conditions of building a constitutional system, influenced the formation of various concepts to the legal status of the individual and the place of the subjective right to engage in economic activity in the system of human and civil rights. There are also alternative points of view, according to which individual authors distinguish constitutional-ideological, constitutional-progressive, constitutional-democratic and other ways to ensure the right to engage in economic activity.
