В данной статье анализируется историческое развитие и современные проблемы земельного регулирования в республике Гвинея. Рассматриваются институциональные изменения в сфере земельных отношений с доколониального периода до недавних реформ. Исследование выявляет устойчивость нерегулируемого правового плюрализма, структурный разрыв между формальными нормами и фактической практикой, а также политико-экономические аспекты, связанные с контролем доступа к земле. Полученные результаты показывают, что относительная неэффективность Гвинейского земельного регулирования не может быть объяснена исключительно техническими и административными недостатками, но является результатом институциональных компромиссов и исторически сложившихся соотношений власти. В заключение обсуждается значение этих выводов для совершенствования управления земельными ресурсами.

This article analyses the historical development and contemporary problems of land regulation in the Republic of Guinea. It examines institutional changes in the field of land relations from the pre-colonial period to recent reforms. The study reveals the persistence of unregulated legal pluralism, a structural gap between formal norms and actual practice, as well as political and economic aspects related to control over access to land. The results show that the relative ineffectiveness of Guinean land regulation cannot be explained solely by technical and administrative shortcomings, but is the result of institutional compromises and historically established power relations. In conclusion, the normative implications of these findings for land resource management are discussed.
